Abstract
In this paper, we will examine the epistemological problems posed by digital evidence as a result of an erroneous conception of the digital fact. We will propose to delimit the problem through the convergence of two complementary theoretical frameworks. On the one hand, an ontology of digital facts, which allows us to understand what kind of entities the facts that emerge from computer systems are and how they exist; and, on the other hand, an epistemology of digital facts, based on the insights provided by analytical philosophy and the epistemology of evidence, particularly those related to conceptual analysis and methods of justifying evidentiary conclusions. The objective is to offer a foundational framework that defines the problem posed by digital evidence and lays the groundwork for a subsequent systematic reconstruction of judicial reasoning in digital environments.
